The Disability Equality Duty (DED) is an important duty aimed at promoting disability equality across the public sector. The DED, also referred to as the general duty, sets out what public authorities must have due regard to in order to promote equality of opportunity.
The Collegiate University is under the statutory duty not to discriminate against disabled students and staff by treating them less favourably than other persons as well as the statutory duty to make reasonable adjustments, both anticipatory adjustments and individual adjustments for disabled staff and students.
The Disability Discrimination Act (DDA) 2005 contains a ‘positive statutory duty’ on public bodies to promote equality of opportunity between disabled and other persons.
In December 2006 the University produced the first Disability Equality Scheme (DES) which outlined how the University, as a public body, fulfils its general duty and the University’s duties under the specific duties regulations which set out the steps which must be taken to assist the University in fulfilling the general duty.
The University’s general duties are that in carrying out our functions we shall have regard for the need to:
- eliminate discrimination that is unlawful under the act;
- eliminate harassment that is unlawful under the act;
- promote equality of opportunity between disabled persons and other persons;
- promote positive attitudes towards disabled persons; and
- encourage participation by disabled persons in public life
- In practice this means that the Collegiate University must take account of disability equality in every area of its day to day work which would include policies, practices, procedures and plans.
The Collegiate University is expected to take the following steps to produce a Disability Equality scheme:
- Secure the engagement of disabled people in the design of the scheme
- Monitor
- Collect data
- Conduct impact assessments
- Report on progress
- Plan for the future
- Collaborate with the other public bodies
