Ministry of Justice (MoJ) reforms: Employers’ and Public Liability Procedural Changes (31/07/13)

The Government has recently announced major changes to the legal procedures that relate to the timescales for handling civil litigation claims, including those for personal injury compensation. This has resulted in the introduction of a new claims procedure for these matters. For more information please refer to:

  • The University insures against damages and associated legal costs arising from those acts or omissions for which it may be legally liable, including Public Liability/Products Liability Insurance, operates (where the University is found to be legally liable) in respect of death, injury, loss of or damage to property, to those who are not employees of the University.
  • Employers' Liability Insurance fulfils the requirements of the Employers' Liability Act, as well as operating in respect of all employees of the University. It also automatically provides an indemnity to the University for any work experience placements undertaken within the University Administrators should display a copy of the University's Employers' Liability Certificate 13-14 (74kb) (University access only) in a prominent place, such as a staff noticeboard at each functional location.
  • The University’s Professional Indemnity policy operates, amongst other things, for claims that might be made against the University or its staff arising from a breach of professional duty.

With all Legal Liability insurances, cover operates only for those acts or omissions for which there is a liability at law.

Employees based overseas

Legal requirements for liability insurances differ for staff based overseas. In order to arrange insurance to suit the relevant country's legal requirements please contact the Insurance Team.

Claims

If you think that a claim, summons or legal correspondence concerning the above could potentially arise after an event, you should contact the Insurance Team or Legal Services Office immediately.

Excess

There is no excess payable under the Public, Products or Employers' Liability covers.

An excess of £2,500 applies in respect of any Professional Indemnity claim, payable by the department concerned.
