It is essential to be clear about the employment status of individuals working in the University. This has a significant bearing on employment rights and on matters such as pension, national insurance and taxation. Employment legislation and case law continue to develop in this area so it is important to take account of the latest regulations and rulings, especially where departments and institutions look at flexible, non-standard ways of meeting their research, teaching and support service requirements. Mistakes may lead to expensive and difficult cases before the Employment Tribunal.
There is no simple checklist that allows employment status to be ascertained in a straightforward way. A number of factors have to be considered and a balanced view taken as to which category is the best fit. The links below provide guidance on the most commonly used arrangements.
